Welcome to Fstvly. These Terms of Service ("Terms") govern your use of the Fstvly mobile app (the "App"), operated by Fstvly, Inc. ("we," "us," "our"). By creating an account or using the App, you agree to these Terms.
1. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your region) to use Fstvly. If you are under 18, you confirm you have permission from a parent or guardian to use the App.
2. Your Account
You're responsible for maintaining the security of your account and password. You agree to provide accurate information when creating your account and to keep it up to date. You're responsible for all activity that happens under your account.
3. User Content
You retain ownership of content you post (photos, chat messages, comments, event listings). By posting content, you grant Fstvly a non-exclusive, worldwide, royalty-free license to host, display, and distribute that content within the App as necessary to operate the service.
You agree not to post content that is illegal, harassing, threatening, or abusive; sexually explicit or involving minors in any inappropriate way; infringing on someone else's intellectual property or privacy; spam, fraudulent, or misleading; or otherwise in violation of these Terms.
We may remove content and/or suspend or terminate accounts that violate these Terms, with or without notice. Users can report content or other users they believe violates these Terms using the reporting tools in the App.
4. Events, Tickets, and Payments
Event organizers are solely responsible for the accuracy of their event listings, compliance with local laws (permits, capacity limits, age restrictions, etc.), and the safety and conduct of their events.
Ticket purchases are processed through our payment provider, Stripe. By purchasing a ticket, you agree to Stripe's terms in addition to ours.
Refunds are at the discretion of the event organizer unless otherwise required by law. Fstvly is not responsible for issuing refunds on an organizer's behalf, except where Fstvly itself is at fault for a processing error.
Fstvly is a platform, not an event organizer. We do not host, produce, or take responsibility for the events listed in the App. Your attendance at any event is at your own risk.
5. Vendor and Staffing Features
Users may apply for or be invited to staffing positions or vendor bookings through the App. Fstvly is not a party to any agreement, payment, or dispute between organizers, vendors, and staff arising from these features, except to the extent Fstvly processed a payment directly.
6. Prohibited Conduct
You agree not to: use the App for any illegal purpose; harass, threaten, or harm other users; impersonate another person or entity; attempt to access another user's account without permission; interfere with or disrupt the App's operation (e.g., reverse engineering, scraping, injecting malicious code); or use the App to circumvent payments owed to Fstvly or event organizers.
7. Termination
We may suspend or terminate your account at any time, with or without cause, including for violation of these Terms. You may delete your account at any time through Settings.
8. Disclaimers
The App is provided "as is" without warranties of any kind, express or implied. We do not guarantee the App will be uninterrupted, secure, or error-free.
9. Limitation of Liability
To the maximum extent permitted by law, Fstvly and its officers, employees, and affiliates are not liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including but not limited to damages related to events you attend or organize through the App.
10. Changes to These Terms
We may update these Terms from time to time. Continued use of the App after changes take effect constitutes acceptance of the new Terms.
11. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles.
